1. Description of Goods and Services
SAPawn (www.sapawn.co.za) is an online marketplace that connects buyers with registered South African pawn shops selling forfeited and pre-owned goods. Each item listed for sale is sold by an individual pawn shop (“the Seller”), identified on the item listing and at checkout. SAPawn acts as the marketplace platform facilitating the transaction.
All goods sold on SAPawn are second-hand/pre-owned items that have been legally forfeited or acquired by registered pawn shops in accordance with South African law, including the National Credit Act and the Second-Hand Goods Act.
SAPawn is a business in the second-hand goods / pawnbroking industry that offers an online marketplace for the sale of forfeited and pre-owned goods from registered pawn shops across South Africa.
2. Delivery Policy
Subject to availability and receipt of payment, orders are typically processed within 1–3 business days. Delivery confirmation will be provided by way of email notification with a tracking number where applicable.
The following delivery options may be available depending on the seller:
- Collection from Shop: Free of charge. Collect the item directly from the seller’s premises at the address shown on the order confirmation.
- Courier Delivery: Available via Paxi, The Courier Guy, Aramex, or other courier services. Delivery costs are calculated and displayed during checkout. Typical delivery timeframe is 2–5 business days depending on destination and courier selected.
- Other Delivery: For items requiring special handling, the seller will contact the buyer with a delivery quote after payment.
Delivery costs, where applicable, are displayed during checkout and added to the total order amount. Risk of goods passes to the buyer upon delivery or collection.
3. Returns and Refunds Policy
Due to the nature of second-hand goods, all items are sold “as-is” unless otherwise stated by the seller. However, the following consumer protections apply:
- Cooling-Off Period: In terms of Section 44 of the Consumer Protection Act (CPA), you have the right to cancel an online purchase within 7 (seven) days of receiving the goods, without penalty.
- Condition: Items must be returned in the same condition as received, with all original accessories and packaging where applicable.
- Administration Fee: Cancellations may attract an administration fee of up to 10% of the purchase price.
- Defective Goods: In terms of Section 56 of the CPA, if goods are found to be defective within 6 months of delivery, you are entitled to a repair, replacement, or refund at the seller’s discretion.
- Refund Process: Approved refunds will be processed via the original payment method within 14 business days.

4. Export Restriction
The offering on this website is available to South African residents only. We do not ship internationally. All transactions are conducted within the borders of the Republic of South Africa.
5. Privacy Policy
SAPawn shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “Personal Information” shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 (POPIA).

6. Payment Options
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer.
Card transactions will be acquired for SAPawn via PayGate (a DPO Group company), a licensed South African payment gateway. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
7. Customer Details and Card Information
Customer details will be stored by SAPawn separately from card details which are entered by the client on PayGate’s secure site. For more details on PayGate refer to www.paygate.co.za.
8. Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
9. Responsibility
SAPawn takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. Individual sellers (pawn shops) remain responsible for the physical fulfilment and condition of goods.
10. Country of Domicile
This website is governed by the laws of South Africa and SAPawn chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

11. Variation
SAPawn may, in its sole discretion, change this agreement or any part thereof at any time without notice. Changes will be posted on this page with an updated “Last updated” date. Continued use of the website constitutes acceptance of the amended terms.
